TransCanada's Eminent Domain Rights Challenged
An Oklahoma family has filed a suit challenging the right of TransCanada Corp. to condemn U.S. property along the route of the proposed Keystone XL pipeline. The suit asserts that a privately-owned foreign corporate entity cannot legally take the private property of U.S. citizens for the benefit of the foreign entity and its government. It further alleges that TransCanada acted in bad faith by failing to make a reasonable offer for the purchase of the property in question before filing a condemnation petition under the law of eminent domain. The suit was filed Friday, Jan. 14, in state district court in Durant, Oklahoma, which is in Bryan County near the Texas-Oklahoma border. Read more...
