Judge Rules Against Minnesota in Coal Dispute

A federal judge reportedly has ruled that a portion of Minnesota’s Next Generation Energy Act violates the Commerce Clause of the U.S. Constitution. The ruling was based on a suit brought in 2012 by the North Dakota Attorney General's office that challenged the Minnesota law's provision requiring carbon emissions to be offset for new coal-fired electricity imported into the state.
