Minnesota Coal Lawsuit Update

A federal judge reportedly has ruled against the State of Minnesota in its attempt to keep a coalition of coal interests led by the North Dakota attorney general's office from continuing a suit filed last November in response to the Minnesota Next Generation Energy Act. The law prohibits new coal-fired power plants in Minnesota and limits out-of-state imports of new coal-based electricity unless the exporting utility can show it has reduced carbon dioxide emissions elsewhere. North Dakota is arguing that federal laws regulating air pollution and the interstate sale of electricity preempt Minnesota's statute and render it invalid. Read more
